These Terms of Use govern your use of the Ponics app, related software, and any related services provided by Kanana Ltd. (“Kanana,” “we,” “us,” or “our”).
By creating an account, accessing, or using Ponics, you agree to these Terms of Use. If you do not agree, do not use Ponics.
1. About Ponics
Ponics is a hydroponic growing app designed to help users log measurements, track grow activity, store grow records, receive nutrient and reservoir guidance, and access related support or community features across a range of hydroponic systems and nutrient setups.
Ponics is provided by Kanana Ltd. Ponics may reference, support, or work alongside third-party hydroponic systems, nutrient products, and related tools, but those third-party products are not owned or controlled by Kanana unless expressly stated.
Some Kanana offerings may also include physical hydroponic products, including Hydro-Planters. These Terms apply to your use of Ponics and related services. Product-specific instructions, warnings, or additional terms may also apply where relevant.
2. Eligibility and account responsibilities
Ponics is not intended for children under the age of 13.
If you are under the age required in your jurisdiction to provide valid consent to the collection, use, or processing of your personal information, you may use Ponics only with the involvement and consent of a parent or legal guardian, where permitted by applicable law.
By using Ponics, you represent that you meet the minimum age requirements that apply to you, or that you are using Ponics with any required parent or guardian consent.
You are responsible for your account and for the accuracy of the information you provide in Ponics.
You agree to:
- provide accurate account information
- keep your login credentials secure
- use Ponics only in compliance with applicable laws
- use Ponics only for personal, non-commercial purposes unless we give written permission otherwise
You are responsible for activity that occurs through your account.
3. Updates and changes
Ponics may change over time. We may update, modify, suspend, or discontinue parts of the app, features, recommendations, or services at any time.
We may also update these Terms of Use from time to time. If we make material changes, we may provide notice in the app, by email, or by other reasonable means. Your continued use of Ponics after updated terms take effect means you accept the updated terms.
4. Important safety notice
Ponics provides software tools and recommendations for hydroponic growing. It does not replace your own judgment, observation, safe handling practices, or applicable instructions for the systems, nutrients, electrical equipment, and other materials you use.
Hydroponic growing involves real-world risks, including:
- water leakage or water damage
- electrical equipment and potential electrical hazards
- plant loss or crop failure
- incorrect dosing, mixing, or adjustment decisions
- problems caused by environmental conditions, water quality, third-party products, or physical equipment
If you use physical hydroponic products, including Hydro-Planters or other related equipment, you are responsible for using them safely and according to any instructions, warnings, and applicable laws.
You are responsible for how you use Ponics and for how you operate your hydroponic system, equipment, nutrients, and related materials.
5. No guarantee of plant, crop, or equipment outcomes
Ponics is intended to support decision-making, not guarantee results.
Kanana does not guarantee:
- plant health, plant survival, or crop success
- compatibility with every hydroponic setup, nutrient line, or growing method
- that any recommendation will match a manufacturer’s instructions or vendor feeding chart
- that recommendations will be accurate in every environment or under every real-world condition
Environmental conditions, plant variety, equipment differences, water source, grower technique, and user-entered data can all affect outcomes.
6. Nutrient recommendations and app outputs
Ponics may provide nutrient recommendations, reservoir correction guidance, modeled values, and other outputs based on plant data, user inputs, system details, and internal models.
These outputs are provided for general guidance only.
You acknowledge that:
- Ponics recommendations may differ from nutrient vendor guidance
- results depend in part on the accuracy of the information you enter
- recommendations may be based on modeled assumptions, published references, community-validated data, or a combination of these sources
- user-provided setup details, measurements, notes, and photos may affect app outputs and record quality
- scores, ratings, or comparisons in Ponics are guidance tools only and are not statements about the overall quality, safety, or effectiveness of a third-party product
You are responsible for reviewing recommendations and deciding how to apply them in your grow.
7. Photos and user-submitted content
Ponics may allow you to upload photos and other records at the plant, system, or grow-space level.
You retain responsibility for the content you upload. By uploading content to Ponics, you confirm that you have the right to upload it and that it does not violate applicable law or the rights of others.
You acknowledge that uploaded content may be stored and used in connection with app functionality, grow records, support, troubleshooting, community features, and other purposes described in the Privacy Policy.
8. Community features and third-party communication channels
Ponics may allow you to submit questions, photos, updates, and related content through support or community features.
Some of these features may be delivered through third-party communication channels used by Kanana to support moderation, responses, and thread continuity.
You acknowledge that:
- Ponics staff, moderators, and authorized helpers may be able to view and respond to community submissions
- some conversations may continue over time, including across a grow cycle or other longer-running discussion
- some conversations may remain limited to staff or moderators, while others may be shared more broadly with other Ponics community members only if you choose to make them public or otherwise available for broader community participation
- content shared through community features may be anonymized at the community level by default, while still being linkable to your Ponics account internally by Kanana for support, moderation, safety, continuity, and product operations
- community replies are informational only and may be delayed, incomplete, or incorrect
You should avoid sharing sensitive personal information through community features unless it is necessary for your use of the feature.
9. Third-party systems, products, and services
Ponics may reference, support, integrate with, or recommend third-party hydroponic systems, nutrient brands, products, services, or content.
Kanana does not own or control those third-party products or services unless expressly stated. We do not guarantee their safety, quality, availability, or performance, and we are not responsible for issues, damages, or losses arising from your use of them.
Ponics also relies on third-party infrastructure and service providers to operate, host, secure, analyze, and support the app.
10. Cannabis use
Ponics does not provide legal advice about cannabis cultivation, possession, sale, or use.
If you use Ponics in connection with cannabis cultivation, you are solely responsible for:
- complying with the laws in your jurisdiction
- meeting any age, licensing, plant count, possession, or other legal requirements
- understanding any health or safety implications associated with cultivation or consumption
Nothing in Ponics is intended to encourage or authorize cannabis-related activity where it is unlawful or restricted.
Kanana is not responsible for any legal, regulatory, health, or other consequences arising from cannabis-related use of Ponics.
11. Aquarium water and other non-standard inputs
If you use aquarium water or other non-standard water or nutrient inputs in your hydroponic system, you do so at your own risk. These inputs may affect plant health, nutrient balance, food safety, or human consumption outcomes.
12. Privacy and data
Your use of Ponics is also subject to our Privacy Policy, which explains what information we collect, how we use it, and what choices you may have.
By using Ponics, you acknowledge that the app may collect account, device, usage, grow-related, image-based, and community-submission data that you choose to provide, and that we may use that information to operate, improve, support, moderate, and secure the app, and for other purposes described in the Privacy Policy.
No method of transmission, storage, or security is completely guaranteed.
13. Disclaimer of warranties
Ponics and related services are provided “as is” and “as available.”
To the fullest extent permitted by law, Kanana disclaims all warranties, representations, and conditions, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the app will be uninterrupted, error-free, secure, or accurate.
14. Limitation of liability
To the fullest extent permitted by law, Kanana Ltd. and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, equipment, plants, or crops arising out of or related to your use of Ponics, related services, or related products.
To the fullest extent permitted by law, Kanana’s total liability for any claim arising out of or related to Ponics will not exceed the greater of:
- the amount you paid to Kanana for Ponics in the 12 months before the claim arose, or
- CAD $50
15. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Kanana Ltd. and its directors, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable legal fees arising out of or related to:
- your use of Ponics
- your violation of these Terms
- your violation of applicable law
- your misuse of the app, related services, equipment, products, or community features
16. Suspension and termination
We may suspend or terminate your access to Ponics if:
- you violate these Terms
- your use creates legal, security, safety, moderation, or operational risk
- we are required to do so by law
- we discontinue the app or a related service
We may also investigate misuse of the app and take any action we reasonably consider appropriate.
Sections that by their nature should survive suspension or termination will continue to apply, including sections relating to liability, disclaimers, indemnity, governing law, dispute handling, and community-content responsibilities.
17. Personal use only
Unless we give written permission otherwise, Ponics is for personal, non-commercial use only.
18. Governing law
These Terms are governed by the laws of Alberta, Canada, without regard to conflict of laws principles.
Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or your use of Ponics will be brought exclusively in the courts of Alberta, Canada, and you agree to the jurisdiction of those courts.
